Coke Gasification Plant
Kansas
On behalf of the owner, performed an analysis of alleged deficiencies in the design of a petroleum coke gasification and syngas plant, resulting in change orders, delay, and loss of productivity claims totaling $25 million against the owner of a refinery. The project involved the relocation of a coal gasification facility from California and redesign of the plant based on petroleum coke feed.

Mineral Processing Plants
Arizona, Colorado, Mexico
Provided Claims Prevention Training Seminars for a Mineral Processing Engineering firm in Denver, Tucson, and Mexico City. Recommended clauses to resolve potential inconsistencies, ambiguities, and conflicts. Prepared clauses for cost and schedule control procedures.

On behalf of the equipment supplier, performed an evaluation of a contractor’s time extension request and delay, disruption, and extra work claim on a coke stacker/reclaimer facility.
Colorado
On behalf of the owner, developed cash flow economic evaluation computer models and prepared capital and operating cost estimates and economic analyses used in the negotiation of the $1.1 billion project loan guarantee for the Colony Shale Oil Project.
Colorado
On behalf of a prime contractor, provided technical, scheduling, loss of productivity, and damages analyses in regard to a $30 million dispute related to the engineering and construction of a high-grade gold processing facility. Prepared the prime contractor's claim, reviewed and prepared a pass-through claim for the mechanical subcontractor, and evaluated the Owner's counterclaim. Evaluated the status of design at contract award, the quality of Owner-supplied equipment, the accuracy of the contractors' bid estimates, and the responsibility and impact of numerous design and construction changes, as well as other issues. Evaluated and apportioned responsibility for delay, disruption, and damages amongst multiple parties. Quantified disruption resulting from cold-weather work, overtime, crowding, shift work, and the cumulative impact of changes. The parties settled prior to court proceedings.
Nevada
Assisted equipment supplier in defending against a $10 million claim by the owner of a gold mine. The project involved the design and construction of a prototype gold ore processing plant.  The owner sought recovery of costs associated with alleged breaches by client resulting from late and deficient proprietary engineering information, late delivery of proprietary equipment, and failure of equipment to perform as specified.  Case was settled during arbitration with client paying no damages.
Nevada
In an International Chamber of Commerce, International Court of Arbitration, provided deposition testimony on schedule delay, loss of productivity, cost reporting, extra work, and damages claims of $50 million on the construction of a $150 million Refractory Ore Treatment Plant. The case was settled in arbitration with the defendant client paying no damages.

Oil Sands Facilities
Canada
On behalf of the insurance company, performed an analysis of a $200 million insurance claim for non-traditional coverages resulting from delays and cost overruns in the construction of a oil sands mine facility and upgrader unit in Alberta. Prepared expert witness reports in support of the ICC Arbitration.

On behalf of the insurance company, performed an analysis of a $500 million claim for business interruption losses due to delays to the start-up and commissioning of an upgrader refinery that was built to process synthetic crude oil from an oil sands production facility. The delays were allegedly caused by a fire at the oil sands production mine site, which delayed the transport of bitumen to the refinery through a 200-plus mile pipeline. Prepared detailed CPM schedule analyses and an expert witness report. Designated as a CPM expert witness in support of the ICC Arbitration in Alberta.

Lead cost and schedule consultant retained by a group of insurance companies to evaluate the reasonableness of a $200 million cost estimate and cost/schedule risks associated with the repair of fire damage to four electrostatic precipitators and enclosures in a large oil sands plant in Alberta. The engagement involved site visits and interviews, and the evaluation of rebuild cost and schedule estimates and supporting documentation, with particular emphasis on assumptions, construction means and methods, labor costs and productivity, field indirect costs, contingency, and expediting and delay costs. Final work products included written reports which addressed the bases for and reasonableness of the repair schedule and cost estimate, and the cost impact of several expedited repair schedule alternatives, and oral presentations to loss adjusters and insurance company representatives.

Provided contract/entitlement analyses, schedule review and risk assessment, for the owner, relative to the design, procurement and construction of a synthetic crude oil upgrader.

Performed an analysis of a major fire at an upgrader in Alberta that processed synthetic crude oil from an oil sands facility. Our client, a major construction company and its insurer, was defending against liability for property damage and business interruption damages amounting to $1 billion.

On behalf of the owner, performed an in-depth integrated cost and schedule risk analysis for a $14 billion oil sands project. Added logic ties and key interface milestone details into the Level II schedule to develop a Risk Analysis Schedule. Provided an assessment as to whether the current schedule and cost forecast was achievable. Provided a “to go” risk analysis on schedule and cost for each project area as well as an assessment of the overall cost (including indirects) and schedule risks. Evaluated current trends in the schedule and cost forecast including field productivity effects. Reviewed the project control processes, provided an assessment including: evaluation of systems/flow of data from EPCs/GCs to the owner, change management processes, and contracts processes for back-charging and processing of claims. Reviewed how material quantities were being managed. Delivered recommendations to further de-risk and improve the probability of achieving project goals.

On behalf of the owner, performed a schedule quality assurance review and schedule risk assessment of the integrated master schedule for a $14 billion oil sands project.
